App terms of use

1. Provider and scope

KCraft Studio LTD (PK Gallery)
Neofytou Nikolaidi & Theod. Kolokotroni
Onisiforou Center, 2nd floor
8011 Paphos, Agios Theodoros
Cyprus

These terms apply to your use of the “PK Gallery” painting app (the “app”). Purchases in the shop at pk-gallery.art are governed by the shop’s terms and conditions.

2. What the app offers

The app shows painting templates based on works by Pegah Koch and creates step-by-step guides from your own photos, with a list of materials, colour mixes and tips. Subscribers can also have their progress checked and ask questions about a step. The app is guided by “Chroma”, an AI painting coach: Chroma is not a person but an artificial intelligence. The list of materials is for information only; no materials are sold in the app.

3. Account

The app creates an account without a name or email address. If you secure it with Apple or Google, you can use it on several devices. Without securing it, the account is lost if you delete the app or lose your device. Details on how we process data are in the app privacy notice.

4. Subscription and single purchases

Some templates and one guide from your own photo per month are free. “PK Gallery Plus” unlocks all published templates, more of your own photos, progress checks and questions; single guides can also be bought without a subscription. The price, term and any trial period are shown before you buy.

Purchases and billing are handled by Apple’s App Store or Google Play, whose terms also apply. Subscriptions renew automatically until you cancel them in your app store account settings. Refunds are requested from Apple or Google. Deleting the app or your account does not end a subscription.

If you download the app from Apple’s App Store, Apple’s Standard Licensed Application End User License Agreement (Apple EULA) also applies.

5. Guides created with AI

Guides, colour mixes, feedback and answers are created automatically with the help of artificial intelligence and may contain mistakes. Colour mixes are approximations; shades depend on the brand, paper and light. Templates based on works by Pegah Koch are reviewed before they are published. Follow the safety instructions on your materials, keep the room ventilated and use fixative and solvents only outdoors or with the window open.

6. Your photos

Only upload photos for which you have the necessary rights, and photos of other people only with their permission. Unlawful, infringing or offensive content is not allowed. You keep all rights to your photos and grant us only the rights needed to store them and to create guides and feedback from them. We may delete content that breaks these rules.

7. Rights to the works by Pegah Koch

The copyright in Pegah Koch’s works, images and guides remains with her. You may use the templates to paint from them privately and for non-commercial purposes. You may keep your own painting, give it away and share photos of it with the note “after a template by Pegah Koch”. You may not present it as a work by Pegah Koch, sell it, or pass on or publish the templates and guides.

8. Liability

We are responsible for loss or damage that is a foreseeable result of our breaking these terms or failing to use reasonable care. We are not responsible for loss or damage that is not foreseeable. Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or in any other case where liability cannot be excluded or limited by law.

9. Deleting your account

You can delete your account with all data and photos at any time under “Profile → Delete account and all data”. Accounts that are not used for 24 months and have no running subscription are deleted automatically. Cancel any running subscription in your app store account as well.

10. Complaints and dispute resolution

If you have a complaint, please write to us first at hello@pk-gallery.art. We are not obliged and do not undertake to take part in dispute resolution proceedings before an alternative dispute resolution body for consumer disputes.

Consumers can also contact the Competition and Consumer Protection Service of the Cyprus Ministry of Energy, Commerce and Industry and, for cross-border purchases within the EU, the European Consumer Centre Cyprus. A list of dispute resolution bodies in the EU is available at consumer-redress.ec.europa.eu.

11. Governing law and changes

These terms are governed by the laws of the Republic of Cyprus. Consumers habitually resident in another country keep the protection of the mandatory provisions of that country’s law. If we change these terms, we will let you know in the app. If any provision is invalid, the remaining provisions remain in effect.
